3.1 About This Policy#
Ship Sherpa Limited operates a technology platform that connects customers requiring delivery services with independent drivers, couriers, riders, fleet operators and delivery businesses.
As part of the driver onboarding and approval process, drivers may be required to provide insurance documents, identity documents, vehicle records, licences, qualifications and other supporting information.
This Policy explains:
- the responsibility of drivers for the documents they provide;
- the checks Ship Sherpa Limited may carry out;
- the limitations of those checks;
- what constitutes fraud or attempted fraud;
- the consequences of fraudulent documentation;
- Ship Sherpa Limited's responsibility where it has been deliberately deceived; and
- the responsibilities of customers using the ShipSherpa platform.
This Policy forms part of the terms governing the use of the ShipSherpa platform. By creating a ShipSherpa customer account, making a booking or using the ShipSherpa platform, the customer confirms that they have read, understood and accepted this Policy.
3.2 Definitions#
For the purposes of this Policy:
“Customer” means any individual, business, organisation or other person that creates a ShipSherpa account, requests a quotation, places a booking or uses a delivery service through the ShipSherpa platform.
“Driver” means any independent driver, courier, rider, fleet operator, delivery company, subcontractor or other delivery service provider that registers with or provides delivery services through the ShipSherpa platform.
“Driver Documents” means all documents, records, certificates, statements, declarations, photographs, information and other evidence provided by or on behalf of a Driver.
“Fraudulent Documentation” means any document or information that is forged, fabricated, altered, digitally manipulated, misleading, incomplete in a material respect, expired, cancelled, suspended, invalid, stolen, unlawfully obtained, issued to another person, vehicle or business, presented outside the scope for which it was issued, or otherwise false or used dishonestly.
“ShipSherpa” means Ship Sherpa Limited, company number 17131128.
3.3 Driver Documents#
Depending on the Driver, vehicle, location, delivery category and type of service being provided, ShipSherpa may require documents including:
- proof of identity;
- proof of address;
- driving licence;
- right-to-work documentation;
- vehicle registration documents;
- MOT documentation;
- vehicle roadworthiness information;
- motor insurance;
- business-use motor insurance;
- hire and reward insurance;
- courier insurance;
- goods in transit insurance;
- public liability insurance;
- employer's liability insurance, where applicable;
- operator licences;
- fleet information;
- subcontractor details;
- Disclosure and Barring Service certificates;
- professional licences or qualifications;
- ADR or dangerous-goods qualifications;
- temperature-controlled vehicle certification;
- food, pharmaceutical or medical delivery certifications;
- airport, airside or restricted-access passes;
- security clearances;
- criminal-record declarations;
- vehicle photographs;
- profile photographs;
- proof of vehicle ownership or lawful use; and
- any other document or information reasonably required by ShipSherpa.
ShipSherpa may require different documents from different Drivers depending on the services they wish to provide. The fact that ShipSherpa has not requested a particular document does not remove the Driver's responsibility to obtain and maintain everything legally required to perform a delivery.
3.4 Driver Responsibility#
Every Driver is solely responsible for ensuring that all Driver Documents and information supplied to ShipSherpa are:
- genuine;
- accurate;
- complete;
- current;
- valid;
- legally obtained;
- unaltered;
- issued by the appropriate organisation;
- issued in the correct name;
- applicable to the correct person, vehicle or business;
- appropriate for the delivery services being provided; and
- sufficient to meet all legal, regulatory, contractual and insurance requirements.
It is the Driver's responsibility to periodically update their documents and details, and to ensure this is done. The Driver is responsible for understanding the insurance, licensing and regulatory requirements that apply to their activities. ShipSherpa's acceptance or approval of a document does not transfer any of the Driver's responsibilities to ShipSherpa.
3.5 Driver Declaration#
Whenever a Driver uploads, submits or otherwise provides a document or information to ShipSherpa, the Driver represents, warrants and declares that:
- the document is genuine;
- the document has not been forged, altered, manipulated or fabricated;
- the information contained in the document is accurate and complete;
- the Driver is legally entitled to possess, use and rely upon the document;
- the document relates to the correct Driver, vehicle, business or fleet;
- the document remains valid and in force;
- the document provides the level and type of cover, permission, authority or qualification represented by the Driver;
- the Driver has disclosed all material exclusions, restrictions, cancellations, suspensions and limitations;
- the Driver has not concealed anything that could affect ShipSherpa's decision to approve the Driver;
- the Driver will comply with all conditions applying to the document;
- the Driver will immediately notify ShipSherpa of any material change; and
- the Driver will not accept a delivery unless they are legally and properly authorised and insured to complete it.
The Driver's declarations apply each time the Driver accesses the platform, accepts a delivery or completes a delivery.
3.6 Continuing Duty to Maintain Valid Documents#
Driver approval is not permanent.
Every Driver has a continuing duty to maintain valid and appropriate Driver Documents throughout the entire period in which they use the ShipSherpa platform.
The Driver must immediately notify ShipSherpa and stop accepting deliveries where:
- an insurance policy expires;
- an insurance policy is cancelled;
- an insurer withdraws or restricts cover;
- a driving licence is suspended or revoked;
- an operator licence is suspended or revoked;
- a qualification or certificate expires;
- a vehicle is no longer roadworthy;
- a vehicle is sold, changed or replaced;
- the Driver changes the vehicle used for deliveries;
- the Driver is no longer entitled to work in the United Kingdom;
- a security clearance or access pass expires;
- a document becomes inaccurate;
- the Driver becomes subject to a restriction affecting their ability to provide services; or
- any other material change affects the Driver's eligibility.
The Driver must provide replacement or updated documentation before accepting any further deliveries. ShipSherpa accepts no responsibility for a Driver's failure to disclose the cancellation, expiry, suspension, revocation, restriction or invalidation of a document.
3.7 ShipSherpa's Verification Process#
ShipSherpa may review Driver Documents using one or more of the following:
- manual document checks;
- automated document checks;
- identity-verification technology;
- facial-matching technology;
- document-verification technology;
- fraud-detection systems;
- expiry-date monitoring;
- database searches;
- insurer checks;
- issuing-authority checks;
- third-party verification providers;
- telephone or email verification;
- additional evidence requests; and
- any other verification method ShipSherpa considers appropriate.
ShipSherpa may determine the nature, scope, frequency and level of its checks based on the Driver, the vehicle, the delivery category, the risk associated with the services, the value or nature of the goods, information available to ShipSherpa, previous Driver conduct, and any concerns or warning signs identified. ShipSherpa may approve, reject, suspend or request further information from a Driver at its discretion.
3.8 Limitations of Verification#
ShipSherpa will take reasonable steps appropriate to its platform and verification process. However, no document-verification process can provide an absolute guarantee that every document is genuine, accurate or valid.
A document may appear genuine even where it has been:
- professionally forged;
- digitally manipulated;
- fraudulently obtained;
- issued using false information;
- stolen from another person;
- cancelled after it was submitted;
- invalidated without ShipSherpa's knowledge; or
- used outside the scope of the applicable insurance, licence or qualification.
The approval, acceptance or display of a Driver Document does not constitute:
- a guarantee that the document is genuine;
- a guarantee that the document remains valid;
- confirmation from the issuing organisation unless expressly stated;
- a guarantee that an insurer will accept a claim;
- a guarantee that insurance applies to every delivery;
- confirmation that every insurance condition has been satisfied;
- confirmation that the Driver has made all required disclosures to their insurer;
- legal or regulatory certification of the Driver;
- a guarantee that the Driver is suitable for every delivery;
- a recommendation or endorsement of the Driver;
- an assumption of the Driver's responsibilities by ShipSherpa; or
- a guarantee that the Driver will comply with the law.
ShipSherpa is not the Driver's insurer, licensing authority, employer or professional regulator.
3.9 Reliance on Driver Information#
ShipSherpa is entitled to rely upon documents, statements, declarations and representations supplied by a Driver unless ShipSherpa knows, or has reasonable grounds to suspect, that the information is false, misleading or invalid.
Where a Driver deliberately provides convincing Fraudulent Documentation, ShipSherpa may not be able to identify the fraud through its normal verification procedures. A Driver cannot transfer responsibility for their fraud, dishonesty or misrepresentation to ShipSherpa merely because ShipSherpa received, reviewed or initially accepted the relevant document.
3.10 Fraud, Attempted Fraud and Fundamental Breach#
Any breach involving dishonesty, fraud, attempted fraud, attempted deception, deliberate misrepresentation, impersonation, concealment of material information or the submission or attempted submission of Fraudulent Documentation constitutes a material and fundamental breach of the Driver's agreement with ShipSherpa.
This applies whether or not:
- the attempted fraud is successful;
- a fraudulent document is approved;
- a delivery is accepted;
- a delivery is completed;
- the Driver receives payment;
- ShipSherpa or a Customer suffers an immediate financial loss; or
- the fraudulent conduct is discovered before or after account approval.
An attempt to commit fraud will be treated in the same way as completed fraud.
3.11 Examples of Fraudulent Conduct#
Fraudulent conduct includes any attempt to:
- upload a forged insurance certificate;
- alter an insurance expiry date;
- alter a policy number;
- alter a Driver's name;
- alter a vehicle registration;
- use another person's insurance;
- use another person's driving licence;
- use another person's identity;
- create multiple accounts using false details;
- conceal that an insurance policy has expired;
- conceal that an insurance policy has been cancelled;
- conceal that a licence has been suspended or revoked;
- misrepresent the scope of an insurance policy;
- claim to hold hire and reward insurance when this is not the case;
- claim to hold goods in transit insurance when this is not the case;
- provide false information during Driver onboarding;
- provide a false address;
- provide false vehicle information;
- submit a document issued to another vehicle;
- submit a document issued to another business;
- impersonate an approved Driver;
- allow an unapproved person to use a Driver account;
- allow an unapproved person to complete a delivery;
- substitute an unapproved vehicle;
- misrepresent a qualification, permit, licence or security clearance;
- provide false information following an accident, theft or incident;
- provide false evidence in support of a claim;
- conceal a criminal conviction or restriction where disclosure is lawfully required;
- manipulate proof-of-delivery evidence;
- manipulate location or tracking information; or
- otherwise deceive ShipSherpa, a Customer, an insurer, a regulator or an authority.
This list is not exhaustive.
3.12 Suspension and Termination#
Where ShipSherpa discovers or reasonably suspects fraud, attempted fraud, fraudulent activity or Fraudulent Documentation, ShipSherpa may immediately:
- suspend the Driver's account;
- restrict access to the platform;
- prevent the Driver from receiving delivery opportunities;
- prevent the Driver from accepting deliveries;
- cancel or reassign current deliveries;
- permanently remove the Driver from the platform;
- terminate the Driver's agreement without notice;
- withdraw any Driver approval;
- withhold or set off payments where contractually and legally permitted;
- investigate current and previous deliveries;
- contact the relevant insurer;
- contact the relevant document issuer;
- notify affected Customers;
- preserve documents, messages and platform records;
- recover losses from the Driver;
- report the Driver to the police;
- report the matter to Action Fraud;
- report the matter to insurers;
- report the matter to regulators, licensing bodies or other authorities; and
- commence civil or criminal enforcement action where appropriate.
ShipSherpa is not required to provide advance notice before suspending a Driver where it reasonably considers that fraud, safety, Customer property, insurance coverage or regulatory compliance may be at risk. ShipSherpa may suspend a Driver while an investigation takes place without this amounting to a final conclusion that fraud has occurred.
3.13 Effect of Fraud on the Driver's Agreement#
Any fraud, attempted fraud, deliberate deception or submission or attempted submission of Fraudulent Documentation will entitle ShipSherpa to terminate the Driver's agreement immediately for material and fundamental breach.
Termination will not remove or cancel:
- the Driver's responsibility for deliveries already accepted;
- the Driver's responsibility for deliveries already completed;
- any obligation to compensate ShipSherpa or a Customer;
- any obligation to reimburse ShipSherpa;
- any indemnity given by the Driver;
- any obligation relating to confidentiality;
- any obligation to preserve evidence;
- any liability arising before termination; or
- any right or remedy already acquired by ShipSherpa.
The Driver cannot rely upon their own fraudulent or unlawful conduct to avoid liability. The Driver remains responsible for the consequences of the fraud even where the Driver's account or agreement has been terminated.
3.14 ShipSherpa's Responsibility for Driver Fraud#
To the fullest extent permitted by law, ShipSherpa accepts no responsibility or liability for any loss, damage, theft, injury, delay, claim, penalty, failed insurance claim, uninsured loss, expense or other consequence arising from:
- fraud by a Driver;
- attempted fraud by a Driver;
- Fraudulent Documentation submitted by a Driver;
- attempted submission of Fraudulent Documentation;
- deliberate misrepresentation by a Driver;
- concealment of material information by a Driver;
- impersonation by a Driver or third party;
- a Driver using another person's identity, insurance, licence or vehicle;
- a Driver allowing an unauthorised person to complete a delivery;
- the cancellation or invalidation of a document without ShipSherpa's knowledge;
- a Driver's breach of insurance terms;
- a Driver's failure to maintain legally required documents; or
- any other dishonest or unlawful act by a Driver,
provided that:
- ShipSherpa did not know that the information or documentation was fraudulent or invalid;
- ShipSherpa could not reasonably have identified the fraud through the verification process it applied;
- the Driver deliberately represented that the information or documentation was genuine, valid and accurate;
- ShipSherpa had not ignored clear evidence or credible information indicating fraud; and
- the loss was not caused or contributed to by ShipSherpa's own negligence, breach of contract or failure to act after becoming aware of the issue.
In those circumstances, all responsibility for the Fraudulent Documentation and its consequences remains with the Driver who submitted, used or attempted to submit it. The approval of a Driver's account does not transfer the Driver's legal, regulatory, contractual or insurance responsibilities to ShipSherpa.
3.15 Driver Liability and Reimbursement#
A Driver responsible for fraud, attempted fraud, misrepresentation, concealment or Fraudulent Documentation will be responsible for all consequences arising from their conduct.
To the extent permitted by law and the Driver Terms, the Driver must reimburse ShipSherpa for all losses, liabilities and reasonable costs resulting from that conduct, including:
- Customer refunds;
- Customer compensation;
- loss of or damage to goods;
- theft of goods;
- redelivery costs;
- replacement delivery costs;
- recovery costs;
- chargebacks;
- insurance excesses;
- uninsured losses;
- failed insurance claims;
- investigation costs;
- third-party claims;
- regulatory penalties;
- professional fees;
- reasonable legal costs;
- evidence-preservation costs;
- account-review costs; and
- reasonable costs incurred in protecting ShipSherpa's Customers, platform or reputation.
ShipSherpa may deduct amounts owed by the Driver from payments otherwise due to the Driver where permitted by the Driver Terms and applicable law.
3.16 Insurance Information#
Any statement on the ShipSherpa platform indicating that a Driver has provided insurance documentation means only that documentation has been supplied and processed through ShipSherpa's applicable review procedure.
It does not guarantee that:
- the policy applies to every delivery;
- the policy covers every type of goods;
- the policy covers goods of every value;
- the policy covers every geographical area;
- every policy condition has been satisfied;
- the Driver has made all required disclosures;
- the Driver has paid all premiums;
- the insurer will accept a claim;
- the insurance has not subsequently been cancelled;
- the Driver has not acted in a way that invalidates the policy; or
- the policy provides compensation directly to the Customer.
Insurance coverage will depend upon the wording of the relevant policy and the circumstances of the incident. ShipSherpa does not control and cannot guarantee the decision of an independent insurer to accept, reject, reduce or limit a claim.
3.17 Independent Drivers#
Unless expressly stated otherwise in the applicable Customer Terms, Drivers using the ShipSherpa platform provide delivery services as independent service providers.
Drivers are responsible for:
- their own vehicles;
- vehicle maintenance;
- vehicle roadworthiness;
- their own personnel;
- their own subcontractors;
- their own insurance;
- their own licences;
- their own qualifications;
- their tax affairs;
- compliance with road traffic laws;
- compliance with transport regulations;
- compliance with employment and worker laws;
- securing goods while in their possession;
- complying with delivery instructions; and
- the manner in which delivery services are performed.
Drivers are not authorised to make promises, warranties, guarantees or representations on behalf of ShipSherpa.
3.18 Customer Responsibilities#
Customers must provide complete and accurate information about every delivery, including:
- the collection address;
- the delivery address;
- the nature of the goods;
- the quantity of goods;
- the dimensions of the goods;
- the weight of the goods;
- the accurate value of the goods;
- fragile contents;
- high-value contents;
- hazardous or restricted contents;
- temperature-control requirements;
- security requirements;
- access restrictions;
- specialist handling requirements;
- time-sensitive requirements; and
- any other information relevant to selecting an appropriate Driver.
Customers must not misdescribe goods or conceal information that could affect the legality of the delivery, the safety of the Driver, the type of vehicle required, insurance coverage, the delivery price, or the Driver's ability to complete the delivery. Additional protection, insurance or specialist delivery arrangements may be required for high-value, fragile, hazardous, regulated, medical, pharmaceutical, temperature-controlled or otherwise specialist goods.
3.19 Customer Acknowledgement#
By registering for or using the ShipSherpa platform, the Customer acknowledges that:
- Drivers provide their own documents and information;
- Drivers are responsible for the authenticity and continuing validity of those documents;
- ShipSherpa may undertake reasonable verification checks;
- no verification process can provide an absolute guarantee against deliberate or professionally concealed fraud;
- a document may be cancelled, invalidated or altered without ShipSherpa's knowledge;
- approval of a Driver does not constitute an insurance guarantee;
- an insurer may reject a claim depending on the relevant policy and circumstances;
- ShipSherpa is entitled to rely upon apparently genuine documentation unless it has reasonable grounds to suspect fraud; and
- responsibility for deliberate fraud or Fraudulent Documentation remains with the Driver responsible for it.
Nothing in this Policy requires a Customer to accept a Driver whom the Customer reasonably believes is acting unlawfully, dishonestly or unsafely.
3.20 Reporting Concerns#
Customers should immediately report any concern about a Driver's identity, vehicle, insurance, documentation, conduct, licences, qualifications, permissions, security clearance or eligibility to complete a delivery.
Reports should be sent to Ship Sherpa Limited at support@shipsherpa.co.uk. Where possible, the Customer should provide the booking reference, the delivery reference, the Driver's name, the vehicle registration, details of the concern, copies of relevant messages, photographs or video evidence, details of any loss, damage or injury, and any other relevant evidence. ShipSherpa may suspend the Driver while it investigates the report.
3.21 Customer Claims and Investigations#
Where an incident involves suspected fraud or invalid Driver Documents, ShipSherpa may assist by preserving available platform records, reviewing the Driver's account, contacting the Driver, contacting the insurer or document issuer, suspending the Driver, providing appropriate information to insurers or authorities, identifying relevant delivery records, and facilitating communication where appropriate.
Any assistance provided by ShipSherpa does not constitute:
- an admission of liability;
- an acceptance that ShipSherpa caused the incident;
- a guarantee that the Customer will recover their loss;
- a guarantee that an insurer will accept a claim;
- a waiver of ShipSherpa's contractual rights; or
- an agreement to compensate the Customer.
3.22 Liability That Is Not Excluded#
Nothing in this Policy excludes or restricts any liability that cannot lawfully be excluded or restricted. In particular, nothing in this Policy excludes or restricts liability for:
- death or personal injury caused by ShipSherpa's negligence;
- fraud or fraudulent misrepresentation committed by ShipSherpa;
- ShipSherpa's failure to perform its own services with reasonable care and skill;
- ShipSherpa knowingly permitting a Driver to continue operating after confirming that the Driver's documents are fraudulent or invalid; or
- any other liability that applicable law does not permit ShipSherpa to exclude.
Nothing in this Policy affects a Customer's statutory rights.
3.23 Relationship With Other ShipSherpa Terms#
This Policy should be read together with:
- the ShipSherpa Customer Terms and Conditions;
- the ShipSherpa Driver Terms and Conditions;
- the ShipSherpa Privacy Policy;
- the ShipSherpa Prohibited and Restricted Goods Policy;
- the ShipSherpa Claims and Compensation Policy; and
- any service-specific terms presented when a booking is made.
Where there is a conflict between this Policy and the Customer Terms and Conditions, the Customer Terms and Conditions will take priority, subject to applicable law. The Driver's responsibilities, warranties, indemnities and reimbursement obligations will also be governed by the Driver Terms and Conditions.
3.24 Changes to This Policy#
ShipSherpa may update this Policy to reflect changes to:
- its services;
- its verification procedures;
- its technology;
- its insurance arrangements;
- its operating model;
- applicable laws;
- regulatory requirements; or
- the types of Drivers and vehicles available through the platform.
The version displayed when a Customer creates an account or makes a booking will apply to that registration or booking, subject to applicable law. Material changes may be communicated through the ShipSherpa platform or to the Customer's registered email address.
3.25 Governing Law and Jurisdiction#
This Policy and any non-contractual dispute arising from it will be governed by the laws of England and Wales. The courts of England and Wales will have jurisdiction, except where applicable consumer law gives a Customer the right to bring proceedings in another part of the United Kingdom.

Customer Sign-Up Acceptance
The following statement is displayed beside a mandatory, unticked acceptance box during customer registration. The Customer must actively select the acceptance box before completing registration.
“I confirm that I have read and agree to the Ship Sherpa Limited Document Integrity, Fraud and Driver Verification Policy. I understand that Drivers are responsible for the authenticity, accuracy and continuing validity of the documents they provide. I understand that ShipSherpa's verification process cannot provide an absolute guarantee against deliberate fraud and that, to the fullest extent permitted by law, Ship Sherpa Limited is not responsible for consequences arising from fraudulent Driver documentation that it did not know about and could not reasonably have identified.”
For each acceptance, ShipSherpa records the Customer's account identification, the date and time of acceptance, the version of the Policy accepted, the IP address or equivalent technical record, the device or browser information where appropriate, and any subsequent acceptance of a revised version.

Driver document verification.
Drivers are solely responsible for ensuring that all insurance, identity, vehicle, licence, qualification and supporting documents supplied to ShipSherpa are genuine, accurate, valid and current.
Any fraud, attempted fraud, deliberate misrepresentation or submission or attempted submission of fraudulent documentation constitutes a fundamental breach of the Driver's agreement and may result in immediate suspension, termination, recovery of losses and referral to the relevant authorities.
ShipSherpa undertakes reasonable verification checks but cannot guarantee that professionally forged, deliberately manipulated, fraudulently obtained or subsequently cancelled documents will always be identified.
To the fullest extent permitted by law, Ship Sherpa Limited accepts no responsibility for consequences arising from fraudulent Driver documentation where it did not know, and could not reasonably have known, that the documentation was fraudulent or invalid.
